KlickPolls Terms of Service

These Terms of Service govern access to and use of KlickPolls websites, applications, hosted poll pages, email polling snippets, Countdown Timers, FancyPolls, analytics, embeds, plugins, and related services. By creating an account, accessing the application, starting a trial, subscribing, or using the services, you agree to these terms.

1. Account responsibility

You are responsible for the accuracy of account information, keeping credentials secure, and all activity under your account. You must promptly notify us if you believe your account has been compromised.

2. Services and acceptable use

KlickPolls provides email-safe polling, hosted response pages, analytics, embeds, Countdown Timers, plugins, and related campaign tools. You may not use the services to violate law, infringe third-party rights, send unlawful or abusive content, interfere with service operation, bypass limits, scrape non-public data, reverse engineer the services, or use the services to distribute malware, deceptive content, or spam.

3. Customer content and campaign data

You retain ownership of poll questions, answer choices, brand assets, uploaded lists, recipient identifiers, responses, and other content you submit. You grant KlickPolls a limited license to host, process, transmit, display, and analyze that content as needed to provide, secure, support, and improve the services.

4. Email platforms and third-party services

The services may rely on third-party providers such as payment processors, email delivery services, hosting providers, analytics infrastructure, and customer-selected email platforms or integrations. KlickPolls is not responsible for third-party outages, policy changes, rendering differences, scanner behavior, or account actions taken by third parties.

5. Plans, trials, billing, and taxes

Paid plans, trials, subscriptions, plugin plans, included usage, overage terms, and billing intervals are shown in the application or an applicable order form. You authorize KlickPolls and its payment processor to charge the selected payment method for applicable fees and taxes. Unless otherwise stated, subscription fees are non-refundable except where required by law or expressly agreed in writing.

6. Results, analytics, and deliverability

KlickPolls provides campaign infrastructure and reporting tools, but does not guarantee any specific response rate, conversion result, deliverability result, email-client rendering outcome, or uninterrupted access to public embeds or hosted pages.

7. Intellectual property

KlickPolls and its software, designs, templates, documentation, trademarks, and service infrastructure are owned by KlickPolls or its licensors. These terms do not transfer ownership of KlickPolls intellectual property to you.

8. Confidentiality and security

Each party may receive non-public information from the other. Each party will use reasonable care to protect confidential information and will use it only for purposes related to the services, except as required by law or authorized by the disclosing party.

9. Suspension and termination

We may suspend or terminate access if you violate these terms, create security or legal risk, fail to pay amounts due, misuse the services, or if continued service would create operational risk. You may stop using the services at any time, subject to any active subscription obligations.

10. Disclaimers

The services are provided on an “as is” and “as available” basis. To the fullest extent permitted by law, KlickPolls disclaims warranties of merchantability, fitness for a particular purpose, non-infringement, uninterrupted operation, and error-free performance.

11. Limitation of liability

To the fullest extent permitted by law, KlickPolls will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost data, or business interruption. KlickPolls’ aggregate liability for claims related to the services will not exceed the amounts paid to KlickPolls for the services during the three months before the claim arose.

12. Indemnification

You agree to defend and indemnify KlickPolls from claims arising from your content, your campaigns, your misuse of the services, your violation of law, or your violation of third-party rights.

13. Changes to these terms

We may update these terms from time to time. If changes are material, we may require renewed acceptance before you can continue using protected areas of the application.
